Sell a Sacramento house with tenants in place.

The lease does not end because the house changed hands. Whoever buys the property steps into the landlord’s position with the agreement that is already running, and that single fact is what makes an occupied house a different sale from an empty one.

WHAT THE BUYER IS ACTUALLY TAKING ON

A tenancy is part of the property.

If there is a written lease with time left on it, the new owner inherits it: the rent, the renewal, the obligations that came with it. If there is no written agreement, the tenancy still exists, and what it requires depends on state law and on rules that may apply where the house sits.

  • When the current term ends, and whether there is an option to renew.
  • What the rent is, whether it has been raised recently, and whether it is current.
  • Whether rent is being paid directly, or through a housing program.
  • What the security deposit was, and whether it was handled the way a deposit is supposed to be handled.
  • Any notices already served, in either direction.
  • The condition the property was in when the tenancy started, if anyone documented it.

WHY SOMEBODY WILL PAY LESS FOR AN OCCUPIED HOUSE

The pool of buyers shrinks, and price follows the pool.

Plenty of buyers want a house empty on the day they take it. A retail buyer with a mortgage often cannot close on anything else, and a household planning to renovate and move in is not going to do it around somebody else’s furniture. So an occupied house asked to sell on the open market can sit.

The other side of that is real, and it is worth saying out loud: a buyer who intends to keep it rented may value the house more than a flipper who needs it empty, because they are buying the income as well as the building. Which one you attract is a question of who you market it to.

THE PARTS THAT ARE NOT MINE TO DECIDE

Ending a tenancy is a legal process, not a conversation.

California has statewide rules about rent increases and about ending tenancies, and cities and counties can add their own on top. Whether a particular notice is valid, how much notice it takes, and what money may be owed along with it are questions for a landlord-tenant attorney. I am not one.

I can buy a house with a tenancy in it and I can talk honestly about what that does to the number. I cannot tell you how to remove a tenant, and I am not going to pretend the two are the same kind of question.

WHAT I NEED TO KNOW TO GIVE YOU A REAL NUMBER

Four facts, then the walkthrough.

The written agreement if there is one, the current rent and when it was set, whether rent is current, and how long is left on the term. With those four I can tell you whether the tenancy helps the offer or hurts it, which is not the same answer for every house.

Access is the other half. An occupied house gets seen on the tenant’s schedule, with notice, or it gets seen from the outside. Both are workable, and both take longer than an empty house.

QUESTIONS I GET ABOUT A HOUSE WITH TENANTS

Straight answers.

Do I have to tell the tenants I am selling?

That depends on the rules that apply where the property sits and on the lease itself, and it is a question for a landlord-tenant attorney rather than for me. What I can say is that a tenant who finds out through a stranger at the door is a worse situation than one who was told.

Can you buy the house with the tenants still in it?

Yes, and sometimes that is the simplest version, because nothing has to change for the people living there. The tenancy becomes part of the terms rather than an obstacle to clear before closing.

What if the tenant wants to leave, or wants to stay?

Both change the value of what is being sold, and both are worth telling me rather than leaving for the walkthrough. A house that will be empty in ninety days and a house that will be rented for two more years are two different properties to a buyer.

Is it worth listing instead?

Sometimes, and the honest answer depends on whether keeping the tenancy or ending it adds value in your market. That is a comparison worth doing on paper, which is what the options comparison is for.

NEXT STEP

Start with the address.

Send the address and I will tell you plainly whether the property and the situation are a fit, and what I would need to know to put something in writing. If it is not a fit, I will say so.
