Sell a Sacramento house during probate.

Probate is a court process that happens to involve a house. It settles who is entitled to what and confirms who is allowed to act. It does not value the property, it does not fix it, and it does not stop it being sold.

THE QUESTION THE COURT ANSWERS

Who may sell, and sometimes on what terms.

A house in an estate can be sold. What has to be established first is who is authorised to sign for the estate, and that authority comes from the court or from the document the estate is being run under. A buyer and a title company will both want to see it rather than be told about it.

  • Where a will grants independent administration. The estate can often act on its own, which removes a court date from the middle of a sale.
  • Where it does not. A proposed sale may need to be confirmed by the court, and that step has its own timetable.
  • Whoever is appointed to act. That is the person a buyer deals with, and it may not be the person who has been living nearby.

I am not a probate attorney and nothing on this page is legal advice. Which of those applies to a particular estate is a question for the attorney handling it, and it is the first question worth asking.

THE TIMELINE IS NOT ENTIRELY YOURS

Anyone who promises you a probate sale in a fixed number of days is guessing.

Court calendars, creditor notice periods, and the steps the estate has to complete all move at their own pace, and none of them are inside a buyer’s control. What a buyer can control is their own side: the walkthrough, the terms, and being ready to close the day the estate is able to.

So I do not quote a closing date for a probate sale as though it were mine to promise. What I can tell you is what I need, what happens when the estate is ready, and that nothing on my side is the thing holding it up.

WHY AN ESTATE OFTEN WANTS AN AS-IS BUYER

The estate is usually short of cash and long on distance.

Estates rarely have money set aside for a new roof, and the people entitled to the house often live somewhere else. Repairs would be paid for by people who have never seen the property, to benefit a sale that is already slower than they would like.

  • No repairs, no cleanout, no preparation before the estate can move.
  • No financing contingency and no lender appraisal, which is a risk the estate does not spend months carrying.
  • One buyer making one set of written terms, which is easier to report to other heirs than a negotiation in progress.
  • The condition is a deduction from the price rather than an expense paid out of the estate.

WHAT I NEED FROM THE ESTATE

Five things, then the walkthrough.

The property address. Whether the house is occupied, empty, or full of belongings. Whether an attorney is involved and who that is. Whether anyone has been appointed to act for the estate yet. And whether there is a mortgage or a reverse mortgage still attached to the property, because that changes the arithmetic and sometimes the timetable.

If the answers are not all available yet, that is normal. Start with the address and the occupancy, and the rest can follow.

QUESTIONS I GET ABOUT A HOUSE IN PROBATE

Straight answers.

Can you buy a house while probate is still open?

Often yes. A purchase can be agreed before the estate has finished, with the closing subject to whoever is entitled to sell being able to sign. The attorney running the estate is the person who can confirm what is possible.

Does the house have to be professionally valued?

An appraisal is a separate question from a purchase offer, and which one is required depends on how the estate is being administered. That is a question for the estate’s attorney rather than for a buyer.

What if the heirs disagree about selling?

Then the disagreement is the thing to resolve first, and it is better handled with one written set of terms on the table than with three different recollections of a phone call. I will not try to talk anybody into a sale.

Do you charge the estate any fees for looking at it?

No. A walkthrough and a set of written terms cost the estate nothing, and it is not committed to anything by receiving them. Any price, fees, and closing costs would be set out in writing before a decision.

NEXT STEP

Start with the address.

Send the address and I will tell you plainly whether the property and the situation are a fit, and what I would need to know to put something in writing. If it is not a fit, I will say so.
