We are acting as a buyer, not as your agent
When Lucano Buys Houses reviews or purchases a property, Kevin Lucano and the purchasing entity are acting as principals, meaning buyers. We are not acting as your agent, we are not your fiduciary, and we do not represent you in the transaction. You are free to hire your own attorney, agent, or adviser, and we encourage you to do that before signing anything.
Submitting a request on this site does not create an agency relationship, does not obligate you to sell, and does not obligate us to make an offer.
Listing your property is always an option
A direct sale is not right for everyone. Listing a property on the open market often exposes it to more buyers and may produce a higher sale price, in exchange for repairs, preparation, showings, and a longer and less certain timeline. If maximizing price matters more to you than speed or convenience, listing may be the better route. Kevin can discuss licensed brokerage services through Windermere Signature Properties at CallKevinRE.com.
You are never required to request an offer from us before listing, and you are never required to list with Kevin if you decide not to sell to us.
We are not appraisers and do not set market value
Any price we discuss is a purchase price we are willing to consider as a buyer. It is not an appraisal, it is not an opinion of market value, and it is not a promise of what a property would sell for on the open market. Direct purchase offers usually reflect the condition of the property, the repairs needed, holding costs, and the risk and cost of reselling it, and they are often lower than a successful listing would bring.
Property condition and required disclosures still apply
Selling as-is does not remove your legal obligations. Under California Civil Code section 1102 and related statutes, a seller of residential property generally must deliver a Real Estate Transfer Disclosure Statement and other required disclosures. You remain responsible for disclosing known material facts about the property. Please complete those disclosures honestly and completely, and ask your own attorney if you are unsure what they require.
Foreclosure situations
The Home Equity Sales Contract Act, California Civil Code sections 1695 through 1695.17, applies when a homeowner whose principal residence is in foreclosure enters an agreement to sell that residence. That law imposes specific requirements, including a written contract in at least 10-point bold type in the language used in the negotiations, particular notices, and a right to cancel within five business days. Those requirements are strict, and violating them can make the contract voidable.
If your property is in foreclosure, tell us immediately, and please speak with a lawyer or a HUD-approved housing counselor before you sign anything. We do not provide foreclosure rescue services, we do not promise to stop a foreclosure, and we do not make credit repair claims. Anyone who tells you that a quick sale will definitely save your home is not being straight with you.
Registered sex offender disclosure
California Civil Code section 2079.10a requires every contract for the sale of residential real property of one to four dwelling units to include the following notice. It is reproduced here in the exact statutory wording. A seller or broker who delivers this notice is not required to provide any additional information about the proximity of registered sex offenders.
Notice: Pursuant to Section 290.46 of the Penal Code, information about specified registered sex offenders is made available to the public via an Internet Web site maintained by the Department of Justice at www.meganslaw.ca.gov. Depending on an offender’s criminal history, this information will include either the address at which the offender resides or the community of residence and ZIP Code in which the offender resides.
Communications and consent
When you submit a property request, you agree that we may contact you by phone, text message, and email about your inquiry. We do not send marketing text messages unless we have your written consent for that, and the consent wording you approved is what governs. You can tell us to stop contacting you at any time, by phone, email, or by replying STOP to a text. We honor opt out requests.
We do not make robocalls. We do not sell your phone number to other businesses.
No legal, tax, or financial advice
Nothing on this website, and nothing we say when discussing a property, is legal, tax, accounting, or financial advice. Selling a property can have tax consequences, including consequences that depend on your basis, your residency, and how you use the proceeds. Please consult your own licensed attorney and tax professional about your situation. We are not attorneys and we are not tax advisers.
Assignment and how we buy
We may buy a property ourselves, or we may bring in a partner, co-investor, or another purchaser to complete the purchase. We may also assign a purchase agreement. Whatever the structure, the price, the terms, who is buying, and who is responsible for costs must be stated in the written agreement you sign. Do not rely on anything said verbally as a substitute for what the contract says. If the specific structure matters to you, ask us to put it in writing before you sign.
Verify our license and where to complain
You can check a California real estate license, or file a complaint about a licensee, through the California Department of Real Estate at www.dre.ca.gov.
Any complaint about a property purchase itself should start with us. Call 916-582-4076 and we will try to resolve it.
